Donor Privacy Notice

This Notice explains how Leeds Arts University will collect and use your personal data. This policy outlines what categories of information we retain and how we use it. Leeds Arts University is committed to looking after any personal information that we collect, is made available to us, or otherwise processed by us, and we do so in accordance with Data Protection Legislation, including the UK GDPR as amended, the EU GDPR and the Data Protection Act.

Where do we get your personal data from?

We collect your personal data when you make a donation to Leeds Arts University, either directly to us or through a third party fundraising platform provider.

We process any personal data that you share with us directly, for example through sending us an email or otherwise engaging with the University. If you choose to donate through a third party fundraising platform, then they will also share that information with us, so that we can accept your donation.

What personal data do we hold?

The personal information that we collect and process about you will include data such as:

  • Name

  • Email address

  • Phone number

  • Date of birth

  • Home address

  • Card details if required, for the purposes of processing the donation only

  • Any other personal information that you choose to share with us

Special Category Personal Data

It is not anticipated that we would regularly need to collect and process your special category personal data. However, in very specific and defined circumstances this may be necessary. Special category data has a very specific definition in Data Protection Legislation, and includes, but is not limited to, your:

  • Health data, including any disability information and/or additional support needs

  • Race

  • Ethnicity

  • Religious or philosophical beliefs

  • Sexual orientation

When we process special category personal data, we are required to apply additional protections to it. We only process it in certain situations, where the law allows us to do so. This could include your consent, where we have a legal obligation, or where the purpose satisfies another legal justification.

Will we send your data to third party organisations?

We do not sell or otherwise transfer personal data to any third parties unless you have consented to this or this is permitted or required by law.

Instances where we may share your personal data with a third party include:

  • Third party service providers, such as for email services and CRM services within the University’s standard administrative environment;

  • On occasion, and where necessary, with University auditors;

  • If you choose to Gift Aid a donation, this information will be shared with His Majesty’s Revenue and Customs (HMRC);

  • On occasion, and where considered necessary, information may be shared with the police and/or other law enforcement agencies.

Any identifiable publicity in regards to any donations would always be undertaken at the donor’s discretion.

When we use third party service providers, we only disclose to them any personal information that is necessary for them to provide their service.

Occasionally we may need to send your personal data outside of the UK. Where this is the case, we will ensure that adequate levels of protection are in place to ensure the security of the transfer. Adequacy regulations in the UK currently apply to countries in the EEA and countries covered by existing EU adequacy decisions. Where these regulations do not apply, additional safeguards will be put in place for any necessary restricted transfer of your personal data.

How will we communicate with you?

We will primarily communicate with you through the contact information that you provided to us at the point of donation, such as your email address and phone number. Communications will always include a receipt of your donation. We may also infrequently send information which may be of interest to you, such as updates or invitations to events in relation to your donation. You can always let us know by emailing alumni@leeds-art.ac.uk if you do not wish to be contacted further once your donation has been completed. Updates about the University’s activities may be published from time to time on our website and/or social media.

Your rights as a data subject

Data Protection Legislation gives you a number of rights to protect your personal data and its use. You have the right to:

  • Withdraw consent where that is the legal basis of our processing

  • Access your personal data that we process

  • Rectify inaccuracies in personal data that we hold about you

  • Be forgotten. This means that in certain circumstances you can request that your details be removed from systems that we use to process your personal data

  • Restrict the processing of your personal data in certain circumstances

  • Obtain a copy of your data in a commonly used electronic form

  • Object to certain processing of your personal data by us

Legal basis for processing your data under Data Protection Legislation

We will only keep your information for as long as is necessary for us to fulfil the purposes we collected it for, including satisfying any legal, accounting or reporting requirements. Sometimes we may anonymise personal information so that you are no longer identifiable by the data. In these cases, we may use this information without further notice to you.

We only process your personal data where we have established a legal basis for processing. There are six bases for processing that are laid out in Data Protection Legislation, which we use to support our processing of your personal information. For the purposes considered by this privacy notice, our legal basis for processing is:

Public Interest

This is when processing is necessary for the performance of a task carried in the public interest. Much of the processing we undertake is under this basis, within our capacity as an educational establishment.

Consent

This basis for processing is used if you provide us with consent to hold your data and process it for a particular reason. For example, this could be to communicate with you via a specific method.

If we were ever to process your special category personal data we would require an additional legal basis for processing of this personal data. The special category information that we may collect in very specific and limited circumstances is listed above, but includes your ethnicity, your religious beliefs, your sexual orientation and information relating to your health (for example if you have a disability or additional support need).

We use the following legal bases to process your special category personal data:

  • For provision of support where you have disclosed information about your physical health, mental health and/or disability status. For example, if you wish to attend an event and require adjustments to be put in place to support your attendance;

  • Equal opportunity monitoring and reporting, including where this is required to external bodies (for example, Jisc);

  • Where you have consented for us to do so.
